Description: You might think that graduate student interns and beginning practitioners working toward their licenses would be the most likely of all counselors to adhere to the ACA Code of Ethics (2014). Their ethics instruction is recent so their knowledge is up to date and they are working under supervision. Yet, interns and new professionals may be at the greatest risk for inadvertently violating the most fundamental ethical standards. Counselors will learn terminology commonly used in court as well as suggestions on do’s and don’ts when testifying. Part two also explores ethical review processes and ethical implications of counselor competency and expertise.

Paved With Good Intentions: Ethical Dilemmas, Court and Ethics Board Review • Part 3 The role of the counselor during legal proceedings is not always clear. During this session, the varying roles one may have as a professional counselor will be discussed, as well as specific do’s and don’ts for different types of roles. A discussion of maintaining clients’ privacy and ethical professional boundaries is included. Suggestions for maintaining appropriate documentation will be offered. This presentation provides practical guidance on managing the often-stressful courtroom environment and how counselors can adhere to ethical obligations and maintain their professional reputability.

Description: Parts 4 and 5 to Paved with Good Intentions focuses on navigating high-conflict families and court professionals. Particular focus in the areas of high conflict divorce and those that are grappling with parenting plan and custody decisions is provided. Counselors who register for this continuing education will learn some things to consider when a client calls to talk about court, as well as when a counselor should talk to an attorney who asks about a case and how to engage the attorney. Two case vignettes are used and then discussed. Effective writing and management of clinical documentation and how to address potential court involvement in the informed consent is addressed.

Title: Risk Management: Identifying Your Client

Description: It can be challenging for counselors to identify who the client is, especially when counseling couples and families. In their 2019 claim report, HPSO stated that failure to clearly define the identified “client” within a couple or group demonstrated an average expense of $5,440. The same report stated that failure to clarify the nature of the relationships the counselor will have with each involved person represented an average expense of $8853. This educational content, sponsored by HPSO, provides counselors with risk management practices to identify their clients.
